Last November, Florida overwhelmingly passed Amendment 2, making Florida one of what is now a majority of states that has legalized some form of marijuana use. But the amendment's passage was not the end of the fight, and the battle over the past six months has included high-profile advocates, governmental figures and administrations and a swell of grassroots supporters. Lost in the protracted conflict is how, exactly, the new medical marijuana law will affect the workplace, and more specifically, employer rights. Although it is still unclear how Amendment 2 will operate once it becomes law, Florida can look to states that were earlier adopters of medical marijuana and find some clarity in how its employers should proceed so that they are safely in compliance. To help clear the air of smoke and uncertainty, Gregory Hearing, a Shareholder at Thompson, Sizemore, Gonzalez and Hearing, P.A., in Tampa, will give tips and guidelines for employers so that they understand how Amendment 2 may change the workplace.
